Thank you for entrusting the care and attention of your pet with us.

To help you read these terms and conditions (Terms): when we refer to "we" or "us" it is a reference to Claws N’ Paws Pet Care and its personnel, officers and agents; and when we refer to "you" or "your" it is a reference to you the client and any of your agents or any executor, administrator or successor. References to "includes" or "including" or "for example" are non- exhaustive and do not imply any limitation.

TERMS AND CONDITIONS

● Your access to and use of the services we may provide is conditional upon your acceptance of and compliance with these Terms. To that end, you agree to pay the applicable fees and we agree to provide the applicable services in accordance with these Terms.

PRIVACY STATEMENT, INFORMATION COLLECTION, USE, AND SHARING

  • ●  We are committed to protecting your privacy.

  • ●  You agree to provide us with whatever information we need to perform the services or these Terms. For example, we may disclose that information to relevant government authorities (if required by the government authority or law). We are the sole owners of any intellectual property developed or created during the performance of these Terms (including the information collected from you) and you agree to assign all right, title and interest in such intellectual property to us. However, we are not responsible or accountable for any information you disclose to a related or affiliated service (for example, information provided to an online platform or via an application such as Pawshake).

  • ●  The information we collect may potentially include "personal information" within the meaning of the Privacy Act 1988 (Cth). We may otherwise collect, use and disclose your "personal information" in accordance with these Terms and to perform the services.

  • ●  We will not sell or rent this information to anyone.

  • ●  We will use your information to respond to you regarding the reason you contacted us, updates on how your pet is doing, and organizing pick up and drop off.

PUBLIC LIABILITY POLICY

  • ●  We agree to provide all services as contracted with the client in a reliable and trustworthy manner.

  • ●  The client acknowledges current Claws N’ Paws Pet Care fees at the time of booking the service.

  • ●  Your Claws N’ Paws Pet Care sitter may alter its fees with reasonable notice to the client. If you object to the altered fees, then you must give us reasonable notice of this before the performance of the applicable services (for example, we may need to end the services or these Terms if you are unwilling to pay the fees, altered or otherwise).

  • ●  The client acknowledges the loading of service fees on Public Holidays. An additional $10 is applicable for all public holidays (including Easter Friday until Easter Monday & Dec 23rd, 2019 inclusive until Jan 3rd, 2020)

  • ●  In consideration of these services and as an express condition thereof, the client expressly waives any and all claims against Claws N’ Paws Pet Care and its agents, unless arising from gross and reckless negligence on the part of Claws N’ Paws Pet Care and its agents. To the extent permitted by law, our liability under these Terms or under law in general (including in tort, contract, equity or otherwise) including for breach of implied conditions, warranties or undertakings is limited to the fees payable by you under these Terms for the performance of the applicable services. You must also indemnify us against any injury, death, loss, cost, liability or damage (Loss) suffered by us or a third party in connection with your breach of these Terms, your negligence or your pet (including any actions, behavioural issues, illness or otherwise of your pet). We take the care and wellbeing of pets very seriously including the pets of other clients. To that end, you agree that we may hold the benefit of this indemnity (and other indemnities in these Terms) on trust for third parties to rely on and enforce including the owners of other pets we care for.

● The Client agrees to notify Claws N’ Paws Pet Care and its agents of any concerns within 24 hours of returning home.

  • Claws N’ Paws Pet Care and its agents shall not be held responsible for pets that bite, suffer an accidental death or escape from faulty fencing or from inside the home due to faulty screens, doors, etc. You must indemnify us against any Loss suffered by us or a third party in connection with the circumstances described in this paragraph.

  • Claws N’ Paws Pet Care and its agents shall not be held responsible for fines levied by council, police or other authorities pertaining to animal behaviour and regulations. You must indemnify us against any Loss suffered by us or a third party in connection with the circumstances described in this paragraph where it is in connection with your pet or your acts or omissions.

  • Claws N’ Paws Pet Care and its agents shall not be held responsible for the retrieval of any missing animal.

  • Claws N’ Paws Pet Care and its agents shall not be held responsible for any complications pets may suffer or actions of pets while they are unattended.

  • Claws N’ Paws Pet Care and its agents shall not be held responsible for the Loss or the actions of any pet that the client has let outside or has instructed Claws N’ Paws Pet Care and its agents to allow outside while Claws N’ Paws Pet Care and its agents are not there. This includes pets with doggie doors and outdoor pets.

  • ●  Claws N’ Paws Pet Care and its agents reserves the right to move an outdoor pet to shelter in the event of extreme temperatures/weather. Claws N’ Paws Pet Care and its agents are not responsible for Loss involved with this move.

● The client understands that all pets (where appropriate) must have their veterinarian details on file.

● The client understands that all pets (where appropriate) must be up to date on appropriate flea treatments, vaccinations and medications.

  • ●  Client agrees to reimburse Claws N’ Paws Pet Care and its agents for all costs (including, but not limited to, medical care) associated with contracting any ailments while exposed to pet(s).

  • ●  Claws N’ Paws Pet Care and its agents will not sit for acutely ill animals or those with uncontrolled medical conditions. We suggest the pet be boarded with a vet.

  • ●  The client is responsible for any and all costs associated with any and all emergency visits to a vet plus the additional time taken.

  • ●  Claws N’ Paws Pet Care and its agents do not accept aggressive animals. Client agrees to be responsible for all Loss (including medical care, legal fees, etc.) if client’s pet should bite/injure another person or animal. You must indemnify us against any Loss suffered by us or a third party in connection with the circumstances described in this paragraph.

  • ●  Claws N’ Paws Pet Care and its agents do not diagnose, provide prognoses, or make therapy decisions. Any veterinary/medical concerns will be referred to a veterinarian. However, we will advise when and if we identify a possible problem to the best of our abilities. You acknowledge that we are not veterinarians.

  • ●  The client authorises Claws N’ Paws Pet Care and its agents to obtain the services of a locksmith should a key/garage opener malfunction. Client is responsible for all related charges and must reimburse us for any costs we incur.

  • ●  Key Pickup & Return Fee. If Claws N’ Paws Pet Care needs to pick up or return a set of house keys there will be a $5 fee per trip. Keys can be dropped in our locked letterbox at any time, please ensure they are identifiable.182 Abbotsford Street North Melbourne VIC 3051

  • ●  Animal Pickup & Return Fee. If Claws N’ Paws Pet Care needs to pick up or return an animal there will be a $5 fee per trip

  • ●  Claws N’ Paws Pet Care and its agents accept no responsibility for negligence or Loss of any kind to home or pet(s) where entry to premises is given to a friend, relative, neighbour or any other party, including Real Estate Agents, Cleaners and/or Tradesmen.
    ● If an event outside of our control (Force Majeure Event) prevents us from performing any

obligations under these Terms, those obligations will be suspended for the duration of that Force Majeure Event. We will use our reasonable efforts to give you notice and details about the Force Majeure Event and we will do our best to minimize or overcome the Force Majeure Event

provided that it is reasonable for us to do so. Once we understand the nature of the Force Majeure Event and its likely impacts, we will also endeavor to tell you about the likely duration of the Force Majeure Event and the obligations affected by the Force Majeure Event.

SERVICES
HOUSE/PET SITTING & HOME VISITS

● It is the client’s responsibility to provide any and all food and provisions necessary to carry out the service.

  • The client must explain all the details related to feeding and housing of their pet(s).

  • The client agrees to pay a shopping charge of $20 plus the cost of additional food or other provisions needed to carry out the service.

  • The basic fee will be reviewed where the pet sitting service requires more complicated feeding or more time-consuming food preparation. This will be reviewed and discussed during the Meet & Greet.

  •  Claws N’ Paws Pet Care offers the following complimentary services with Pet Sitting, bringing in the mail and newspapers, putting out and bringing in rubbish bins on the appropriate days, watering indoor plants. This will be discussed during the Meet & Greet.

  • Subject to other provisions in these Terms, Claws N’ Paws Pet Care will administer basic medication but must be fully informed and shown how the medication is to be given.

  • ●  Claws N’ Paws Pet Care requires a 50% deposit to confirm the booking, with the balance due before commencement of the service.

  • ●  For any account not settled within 14 days of the due date, a reminder will be sent with an additional accounting fee in respect of administrative costs incurred.

  • ●  Should it be necessary for further reminders to be sent, further charges will be incurred. These however may be deducted if payment is made promptly (any deduction will be at our absolute discretion).

● After due notice, overdue accounts will be referred to our Debt Collection Agency and further charges will be levied in respect of costs incurred in collecting the debt.

● Claws N’ Paws Pet Care does not accept cheques for payments.

HOME BOARDING & DOGGY DAYCARE

  • Home Kennelling clients must be vaccinated to C5 level no later than two weeks before boarding.

  • The client accepts responsibility and payment to repair all damage done to the home or property while his/her dog is being boarded.

One ‘Overnight Home Kennelling Day’ is charged from ‘check in’ the day the dog is dropped at our home until ‘check out’ up to, but no longer than 24 hours after ‘check in’. any time after this will be charged as daycare.

DOG WALKING

  • No dog will be walked by Claws N’ Paws Pet Care unless vaccinated to a C5 level no later than two weeks before walks commence.

  • The client will provide keys where necessary for access.

  • All new dogs will be subject to a maximum 6-week probationary period. We may change the duration of the probationary period at our absolute discretion.

  • If Claws N’ Paws Pet Care deems the behaviour or personality of a dog has changed to the extent

it has become a danger to itself, us or other animals or persons, we reserve the right to cease the Dog Walking contract.

KEYS AND HOME SAFETY

  • Claws N’ Paws Pet Care makes every effort to pick-up client’s house keys at the complimentary Meet & Greet, if this is not possible keys can be dropped in the Claws N’ Paws Pet Care locked mailbox, 182 Abbotsford Street North Melbourne VIC 3051.

  •  Key Pickup & Return Fee. If Claws N’ Paws Pet Care needs to pick up or return a set of house keys there will be a $5 fee per trip. Keys can be dropped in our locked letterbox at any time, please ensure they are identifiable. 182 Abbotsford Street North Melbourne VIC 3051

  •  Claws N’ Paws Pet Care tags and marks all client keys with an individual number (not address).

  •  Claws N’ Paws Pet Care can retain house keys for the convenience of clients for future pet services.

  •  The client will ensure that alarm procedure is fully explained and understood at the time of the Meet & Greet.

  •  However, if for whatever reason the alarm should be tripped all associated costs are the responsibility of the client. You must reimburse us promptly for any costs which we incur, which must be no later than 7 days from notice by us.

  •  It is the client’s responsibility to ensure their pets will be safe when left at home.

● Claws N’ Paws Pet Care and its agents accepts no responsibility for negligence of any kind to home or pets where entry to premises is given to a friend, relative, neighbour or any other party including Real Estate Agents, Cleaners or Tradesmen.

The client must inform Claws N’ Paws Pet Care or its agents if the premises are under close circuit or direct stream image recording.

● Either you or we have the right to terminate these Terms at any time by notice in writing (including email and SMS) or verbally to the other party if the other party commits a breach of any provision of Terms. If you notify us via SMS or verbally, you must confirm such termination within 24 hours in writing, which must be by either email or letter (unless we otherwise agree). We may end these Terms and any services at any time by notifying you in writing (including email and SMS) or verbally. You must promptly pay any amounts owed to us, which must be no later than 7 days from the notice. All indemnities or obligations to pay amounts incurred or payable prior to the termination or end of these Terms survive the termination or end of these Terms.
